Please read all of these terms and conditions (the “Terms and Conditions”) carefully before using this website. By accessing this website or another website of the Alberta Medical Association (C.M.A. Alberta Division) (the “Website”) you accept the terms and conditions of use in full, and your continued use of the Website constitutes your acceptance of the Terms and Conditions and the Privacy Policy referenced below, as amended from time to time.

Access

The Alberta Medical Association (C.M.A. Alberta Division) (the “AMA”) hereby grants you permission to use the Website, provided that:

(i) your use of the Website is solely for your personal use;
(ii) you will not copy or distribute any part of the Website in any medium or manner inconsistent with these Terms and Conditions without the AMA's prior written consent;
(iii) you will not alter or modify any part of the Website other than as may be reasonably necessary to use the Website for its intended purpose; and
(iv) you will otherwise comply with these Terms and Conditions.

User Account

In order to access some features of the Website, you will have to create an account. You shall not share your or use another's account. When creating your account, you must provide accurate and complete information. You are solely responsible for protecting your data when using the Website, the activity that occurs on your account, and you must keep your account password secure. You must notify AMA immediately of any inaccurate information, breach of security or unauthorized use of your account.

AMA reserves the right to establish data transfer restrictions and to limit the total amount of data transfer associated with your account. User accounts may be closed by the AMA should the total amount of data transfer exceed an amount deemed excessive in the AMA's sole discretion.

You agree not to use or launch any automated system, including without limitation, "robots," "spiders," "offline readers," that accesses the Website in a manner that sends more request messages to the AMA servers in a given period of time than a human can reasonably produce in the same period by using a conventional on-line web browser. You agree not to collect or harvest any personally identifiable information, including user names, from the Website.

Content Liability

The AMA makes every effort to ensure, but does NOT GUARANTEE, that the information presented on the Website (and the websites of the AMA's related programs) is completely accurate and up to date.

The Website, including the text, software, scripts, graphics, photos, sounds, music, videos, and interactive features and information therein, is provided “as-is”, “with all faults” and without any warranties of any kind, either express or implied for your information and use only. Under no circumstances will the AMA be liable in any way for any Content or information posted on the Website, including, but not limited to, any errors or omissions, or for any loss or damage of any kind incurred as a result of the use of any content or information posted.

The AMA takes no responsibility for the content on the external websites to which the Website or the websites of AMA’s related programs link. Please note that you use the information and services of this Website, and any links to third parties, at your own risk. By using the Website, you expressly discharge AMA from any and all liability arising from your use of any third-party website.

The AMA reserves the right to update, add, edit or remove information and services available on this Website at any time. This includes content generated by users of the Website.

Privacy

By using the Website you consent to the use of cookies. Like most websites, the AMA uses cookies to enable it to retrieve user details for each visit. Cookies are used to improve usability for site visitors and to enhance and personalize site functionality.

The AMA records and tracks anonymous usage statistics, through its own analytics tools and third-party tools, such as Google Analytics, to help it understand how people are using the Website and to improve the Website services.

Logged in visitors:

In addition to the above, users with accounts can log into the Website and update their personal information and preferences. Further, for logged in users, non-anonymized usage data is collected and analyzed by the AMA to help support and improve all AMA services for and interactions with AMA members.

All member data collected and stored by the AMA is managed in accordance with our organizational privacy commitment statement (the “Privacy Policy”) and you acknowledge that you have read and understood the Privacy Policy.

User-generated Content

Various features on the Website allow for user input and collaboration, including, but not limited to commenting, updating personal information, filling out applications and calculating information. Users add content at their own risk and are responsible for the accuracy of the information they provide. AMA does not guarantee any confidentiality with respect to any such submissions. You agree that you are responsible for your own conduct and communications while using the Website and you agree that you will not:

  • post or update inappropriate, defamatory, destructive, obscene or unlawful content; 
  • defame, abuse, harass, threaten, stalk or otherwise violate the rights of others; 
  • post content that infringes any intellectual rights of others; 
  • circumvent, disable or otherwise interfere with security related features of the Website or features that prevent or restrict use or copying of any content.

The AMA reserves the right to remove or edit user-generated content at our discretion. The AMA has the sole discretion to decide whether content or a user submission is appropriate and complies with these Terms and Conditions. AMA reserves the right to remove content and user submissions without prior notice and to terminate a user's access to the website, if such user is in violation of these Terms and Conditions.

AMA does not endorse any user submission or any opinion, recommendation, or advice expressed therein, and AMA expressly disclaims any and all liability in connection with user submissions. You understand that when using the Website, you will be exposed to user submissions from a variety of sources, and that AMA is not responsible for and makes no warranties concerning the accuracy, usefulness, safety, or intellectual property rights of or relating to such user submissions. You further understand and acknowledge that you may be exposed to user submissions that are inaccurate, offensive, indecent, or objectionable, and you hereby waive any legal or equitable rights or remedies you may have against AMA with respect thereto.

You grant an indefinite royalty free license to the AMA to use any content you provide as it sees fit without remuneration.

Intellectual property

All content provided and the trademarks, trade names, service marks and logos contained therein, are owned or licensed to the AMA. Unless otherwise stated, AMA and/or its licensors own the intellectual property rights for all material on or comprising the Website and all intellectual property rights are reserved.

You must not:

(i) Republish material from the Website;
(ii) Sell, rent or sub-license material from the Website;
(iii) Reproduce, duplicate or copy material from the Website; or
(iv) Redistribute content from the Website (unless content is specifically made for redistribution);
without the prior written consent of the content owner, payment of the applicable fee, or both, as applicable.

Damages

You agree that your use of the Website is at your sole risk. You hereby waive any legal or equitable rights or remedies you may have against the AMA with respect to your use of the Website or matters arising therefrom. To the maximum extent permitted by applicable law, the AMA excludes all representations, warranties and conditions relating to the Website and the use of this Website (including, without limitation, any warranties implied by law in respect of satisfactory quality, fitness for purpose and/or the use of reasonable care and skill). For clarity, AMA makes no warranty concerning bugs, viruses, Trojan horses or similar problems which may be transmitted to or through the Website by any third party, or concerning damage of any kind incurred resulting from use of the Website. The AMA does not endorse and is not responsible for any product or service advertised or offered by a third party through the Website or any hyper-linked website.

In no event shall the AMA, its officers, directors, employees or agents be liable to you for any direct, indirect, incidental, special, punitive or consequential damages resulting from any claim, injury or damage incurred by you from your use of the Website, or its content.

You agree to defend, indemnify and hold harmless the AMA, its officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to legal fees) arising from:

(i) your use of and access to the Website;
(ii) your violation of any aspect of these Terms and Conditions;
(iii) your violation of any third party right, including without limitation any copyright, property, or privacy right; or
(iv) any claim that one of your user submissions caused damage to a third party.

This defence and indemnification obligation will survive these Terms and Conditions and your use of the Website.

General

You confirm that you are either at least 18 years of age, or possess legal parental or guardian consent, and are fully able to enter into the terms, conditions, obligations, representations, and warranties described in these Terms and Conditions, and to abide by and comply with them.

You agree that these Terms and Conditions will be governed by the laws of the Province of Alberta, Canada whose courts shall have exclusive jurisdiction. You agree that any cause of action in relation to the Website must be commenced within one (1) year after the cause of action accrues, or such cause of action is permanently barred.
